Terms of Use

IMPORTANT: PLEASE READ THESE TERMS OF USE (“TERMS,” “AGREEMENT”) CAREFULLY BEFORE CREATING AN ACCOUNT, ACCESSING, OR USING THE 49JILIFUN WEBSITE, MOBILE APPLICATION, OR ANY RELATED SERVICES (COLLECTIVELY, THE “PLATFORM”).

By clicking “I Agree,” creating an account, or otherwise accessing the Platform, you (“User,” “you,” or “your”) enter into a legally binding contract with 49JiliFun (“we,” “us,” “our,” or the “Company”). If you do not agree to all Terms, you may not use the Platform.

These Terms incorporate by reference our Privacy and Policy Statement and Responsible Gaming Policy.

1. Definitions

  • “Account” means your registered user profile on the Platform.

2. Eligibility and Account Registration

By registering, you represent that you meet this requirement. We reserve the right to verify age at any time and will close accounts belonging to minors, forfeiting any associated balances per Section 9.

3. Platform Use and Conduct

3.1 Permitted Use You may use the Platform solely for personal, non-commercial entertainment purposes in accordance with these Terms.

3.2 Prohibited Conduct You expressly agree NOT to:

  • Violate any applicable law, regulation, or regulatory guidance.
  • Use the Platform for illegal purposes, including money laundering, fraud, or terrorist financing.
  • Employ bots, scripts, automated software, or other means to manipulate game outcomes or gain unfair advantage.
  • Reverse engineer, decompile, or disassemble any part of the Platform.
  • Interfere with or disrupt the Platform’s servers, networks, or security systems.
  • Harass, abuse, threaten, or defame other users or our staff.
  • Upload malicious code, viruses, or harmful content.
  • Impersonate any person or entity.
  • Engage in collusion, chip dumping, or other forms of cheating.

3.3 Intellectual Property All Content, trademarks, logos, software, and underlying technology on the Platform are owned by 49JiliFun or licensed to us. You receive a limited, non-exclusive, non-transferable license to use the Platform for personal entertainment. You may not:

  • Copy, reproduce, distribute, or publicly display Content without written permission.
  • Create derivative works based on Platform Content.

4. Deposits, Withdrawals, and Virtual Currency

4.1 Deposits All deposits must be made through approved payment methods. We do not accept cash deposits. Minimum and maximum deposit limits apply and are displayed in your account dashboard. Deposits may be subject to verification delays for fraud prevention.

4.2 Withdrawals Withdrawals are processed to the original payment method where possible. Processing times vary by method:

  • E-wallets: 24-48 hours
  • Bank transfers: 3-7 business days

We do not warrant that:

  • The Platform will be uninterrupted, timely, secure, or error-free.
  • Results obtained from using the Platform will be accurate or reliable.
  • Any errors in the Platform will be corrected.

7.2 Limitation of Liability TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL 49JILIFUN, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATING TO:

  • YOUR USE OR INABILITY TO USE THE PLATFORM.
  • UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA.
  • STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE PLATFORM.
  • ANY OTHER MATTER RELATING TO THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE GREATER OF:

  • THE TOTAL AMOUNT YOU PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR
  • ONE HUNDRED UNITED STATES DOLLARS (USD $100.00).

7.3 Force Majeure We are not liable for any failure or delay in performance due to Force Majeure events. During such events, we may suspend the Platform without notice.

8. Indemnification

You agree to indemnify, defend, and hold harmless 49JiliFun and its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs (including reasonable attorneys’ fees) arising from or relating to:

  • Your use of the Platform.
  • Your violation of these Terms.
  • Your violation of any third-party right.
  • Your violation of any applicable law.

9. Termination and Account Closure

9.1 Termination by You You may close your account at any time by contacting support@49jilifun.site. Closure requests are processed within 7 business days. Any remaining Virtual Currency or bonus balances may be forfeited upon closure.

9.2 Termination by Us We may suspend or terminate your account immediately, without prior notice, for:

  • Violation of these Terms or any applicable law.
  • Suspected fraud, money laundering, or other illegal activity.
  • Extended inactivity (12+ months).
  • Chargebacks or payment disputes.
  • Any reason at our sole discretion.

9.3 Effects of Termination Upon termination:

  • Your license to use the Platform ceases immediately.
  • You must cease all use of Platform Content.
  • We may delete your account data subject to legal retention requirements.
  • Provisions intended to survive termination (Sections 3.3, 7, 8, 10, 11, 12, 13) remain in effect.

10. Dispute Resolution and Governing Law

10.1 Governing Law These Terms are governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to conflict of law principles.

10.2 Informal Resolution Before filing any formal claim, you agree to contact us at legal@49jilifun.site to attempt informal resolution. We will make good-faith efforts to resolve disputes within 30 days.

10.3 Arbitration If informal resolution fails, any dispute arising from or relating to these Terms or the Platform shall be finally resolved by binding arbitration administered by the Philippine Dispute Resolution Center, Inc. (PDRCI) in accordance with its Arbitration Rules. The arbitration shall:

  • Be conducted in English.
  • Take place in Makati City, Philippines.
  • Be decided by a single arbitrator.
  • Be confidential.

10.4 Class Action Waiver TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS.

10.5 Exceptions Notwithstanding the arbitration agreement, either party may bring an individual action in small claims court or seek injunctive relief in a court of competent jurisdiction for intellectual property violations.

11. Third-Party Services and Links

The Platform may integrate with or link to third-party services, including payment processors, social media platforms, and responsible gaming resources. We do not control and are not responsible for:

  • The content, accuracy, or policies of third-party services.
  • The security of information transmitted to third parties.
  • Any damages arising from your use of third-party services.

Your use of third-party services is governed by their respective terms. We encourage you to review PayPal’s User Agreement (external), Stripe’s Terms (external), and other relevant third-party terms before use.

12. Severability and Waiver

If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force. Our failure to enforce any right does not constitute a waiver of that right.

13. Entire Agreement

These Terms, together with our Privacy and Policy Statement, Responsible Gaming Policy, and any specific game rules or promotional terms, constitute the entire agreement between you and 49JiliFun regarding the Platform. They supersede all prior agreements, understandings, and representations.

14. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction in connection with a merger, acquisition, or sale of assets.
